Missouri Attorney General Andrew Bailey and six other Attorneys General wrote to Environmental Protection Agency Director Michael Reagan and Office of Management and Budget Director Shalanda Young to enforce the law in writing. and urged the Biden administration to follow the law. It also allows the EPA to issue a rule permitting year-round sales of E15 ethanol gasoline within the state.
“As Attorney General, I will enforce the law to its letter, which includes holding me accountable when the actions of federal agencies like the EPA lead to increased strain on working families,” he said. said Attorney General Bailey. “My office is working to reduce unnecessary paperwork and ensure the EPA is responsive to the state’s request to lower fees at the pump.”
Despite the air quality benefits, sales of the E15 are limited during peak summer operating periods due to outdated provisions of the Clean Air Act. E15 is a cleaner and more cost-effective gasoline blend than E10, which consists of 15% ethanol, but has stricter limits.
Federal law allows the governor to request the EPA to issue a rule authorizing E15 and requires the EPA to issue a rule within 90 days. A bipartisan coalition of states made her request in 2022, but the EPA has yet to issue a rule required by law.
Seven state attorneys general wrote this letter to remind the EPA of its legal obligation to comply with the request.
“Given the seriousness of this issue, the undersigned Attorney General requests the Office of Management and Budget to promulgate the regulations required by the Clean Air Act by the end of January,” the Attorney General wrote.
