The California Bar Association has announced new disciplinary action against John Eastman, who was involved in former President Donald Trump’s efforts to overturn the 2020 election results.
State bar bar attorneys have brought 11 counts of action against Eastman, accusing him of violating various legal ethics rules in multiple episodes, lawsuits, and other conduct.
Among the modus operandi targeted by the new disciplinary proceedings were Eastman’s court filings with the Georgia and Supreme Courts, a pressure campaign to block Congressional certification of then-Vice President Mike Pence, and Eastman’s Mann promotes false election fraud allegations.
“Nothing is more sacred to American democracy than free and fair elections and the peaceful transfer of power,” said George Cardona, Chief Justice of the State Bar Association, in a statement. “The notice of disciplinary action alleges that Mr. Eastman violated this duty in order to steal the will of the American people and facilitate an attempt to overturn the election results for the highest office in this country. “This is a vicious and unprecedented attack on our democracy. He must be held accountable.”
Eastman’s attorney, Randall Miller, said in a lengthy statement that Eastman “disputes ‘every aspect’ of the lawsuit brought against him by the State Bar Association,” and that the indictment is essentially Miller said Eastman would also challenge them and present his position.
According to the indictment, he allegedly violated ethics rules by promoting voter fraud claims in lawsuits, public statements, and other aspects of his legal practice. He also said that legal theories he knew or should have known were “fundamentally flawed” to claim Pence could interfere with Congressional certification of the 2020 election results. Even if you claim that there is, you will be criticized.
Eastman now faces a deadline to respond to the charges.
Although the proceedings will eventually move to the state judicial courts to rule, the state Supreme Court will have the final say on whether disciplinary proceedings are necessary in the event of an attorney’s suspension or disqualification. .
Legal counsel said Eastman knew, or should have known, that Pence’s scheme was unconstitutional — a key element of the proposal he put forward after the election.
By failing to uphold the Constitution, Eastman violated the Lawyer’s Code of Ethics, the disciplinary papers allege. He has also been charged with trying to mislead a court and moral misconduct, including alleged misrepresentation.
Citing a series of post-election lawsuits and comments from members of the Trump administration, election officials, and other “reliable sources” that exposed allegations of election fraud, the disciplinary papers allege Eastman’s falsehoods. Election claims that you knew or should have known were going on.
Eastman is the latest Trump-related attorney to face disciplinary proceedings for work on an election reversal plan. The DC Disciplinary Commission recently issued preliminary findings that former Trump attorney Rudy Giuliani violated ethics rules in a Trump campaign lawsuit, before the findings were finalized and penalties were determined. Additional procedures will be carried out on
Like Sidney Powell, an attorney who represented the Trump campaign in a lawsuit challenging the 2020 election results, former Justice Department attorney Jeffrey Clarke, who helped push Trump’s efforts to overturn the election results, faces disciplinary action. facing proceedings.
